In order for a foreigner to purchase a condominium unit in Cambodia – registered in the name of the foreign person, the following requirements must be met:
- The developers of the condominium unit complex must establish a company in Cambodia that will then register the building under the strata title process (known in Cambodia as co-ownership) (this is not something that an incoming buyer has to deal with);
- The total available space owned by foreign persons in the building must not constitute more than 70% of the total building space; and
- Any units owned by a foreign person must be located above the ground floor.
At the moment, it is only new developments that have been registered as co-owned buildings with strata title that are available for foreign persons to purchase and own legal title.
